    Terms and conditions for the use of cards issued by Banca Transilvania in Fitbit Pay / Garmin Pay / Apple Pay / Google Pay

  • 1. About these Terms and Conditions

    Banca Transilvania S.A. (hereinafter referred to as "the bank" or "BT"), is a credit institution, a Romanian legal entity with registered office in Cluj-Napoca, Cluj - Napoca, str. Calea Dorobanților nr. 30-36, postal code 400121, telephone 0264 308028, registered with the Trade Register under no. J12/4155/1993, unique code RO 5022670.

    BT allows eligible Banca Transilvania cards (hereinafter referred to as "BT cards") to be used for payment and in the Fitbit Pay (hereinafter referred to as "Fitbit Pay"), Garmin Pay (hereinafter referred to as "Garmin Pay"), Apple Pay (hereinafter referred to as "Apple Pay") and Google Pay (hereinafter referred to as "Google Pay") payment apps. Details of which BT cards are eligible for enrollment and use in Fitbit Pay, Garmin Pay, Apple Pay and Google Pay can be found in the relevant section of these Terms.

    About Fitbit Pay, Garmin Pay, Apple Pay and Google Pay and who Fitbit, Garmin, Apple and Google are, you can find details on the website www.fitbit.com, www.garmin.com, www.apple.com, respectively www.google.com, including the privacy policies of these providers, to which the processing of your personal data will be subject when you use these services.

    Please carefully read these 'Terms and Conditions' (the 'Terms') which govern the registration, activation and use of a BT card in Fitbit Pay, Garmin Pay, Apple Pay and Google Pay.

    If there is any inconsistency between the terms of your Fitbit/ Garmin/ Apple/ Google account and these Terms, these Terms will apply to payments made with your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    2. Limitations of liability

    These Terms only apply to the use of BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    These Terms do not apply to services/products contracted/purchased from the provider of the device you are using, your mobile network or other third party sites or services that integrate or enable the provision of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. They are third parties to Banca Transilvania and have their own contracts to which you are bound when you provide information about yourself, use their services or visit their websites. Banca Transilvania is not responsible for the legality of the provision/performance of the products/services of the device provider and/or third parties, nor for the security, accuracy, legality or any other aspect of such products/services provided by them.

    It is your responsibility to read and understand the terms of the agreements provided by these third parties before creating, activating or using your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    We are not responsible for and do not provide any support or assistance for any third-party hardware, software or other products or services (including Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and your device). If you have any questions or problems with a product or service offered by Fitbit/ Garmin/ Apple/ Google or a third party, please contact that vendor/third party for assistance.

    Subject to the General Terms and Conditions of Business of Banca Transilvania applicable to the BT card, you agree that the features and functionality of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay may be automatically enhanced or updated without any prior notice. We may at any time decide to expand, reduce or suspend the type and/or number of transactions permitted using a BT Card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or change the process of enrolling a BT Card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    3. Banca Transilvania cards eligible for enrollment and payment use in Fitbit Pay/ Garmin Pay /Apple Pay/ Google Pay

    BT cards eligible for enrollment and payment use in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay are the cards issued by Banca Transilvania under the Visa aegis, regardless of whether they are debit or credit cards, and regardless of whether they are issued in the name of a natural or legal person customer.

    BT cards issued in the name of both the cardholder and the additional cardholder (nominated cardholder) may be enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, subject to the provisions of the Enrolling a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay section of these Terms.

    4. Minimum requirements for using BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay apps

    To use your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay you must first have or create a Fitbit/ Garmin/ Apple/ Google account, set up as required by Fitbit/ Garmin/ Apple/ Google. You also need a compatible device.

    You can add the same BT card to multiple devices at the same time. Your device provider may impose limitations or restrictions on the use of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and/or have minimum software and hardware requirements for the compatible device used.

    Compatible device means any smartwatch, wristband, smartphone or other type of device that allows payments via Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. Compatible devices are those listed as such on the Fitbit/ Garmin/ Apple/ Google website.

    You agree to use the BT card only with a device that is properly equipped for Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and to abide by all applicable Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay terms and conditions. You will need to contact your device provider directly to find out if your device is compatible for use with Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    Before registering for Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, you must ensure that only your password/ security details are linked to the BT card you wish to use on that device in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. This password/ security details will be used to authorize transactions with the BT card issued in the cardholder's name.

    Banca Transilvania is in no way responsible for the requirements of Fitbit/Garmin/Apple/Google or third parties with whom it collaborates to impose conditions on the creation of the Fitbit/Garmin/Apple/Google account or compatible devices.

    5. Protecting your password/security details

    Before entering your BT card details into Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay you will be asked to set a password/security details, which you will use to access Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. The conditions, instances and frequency with which you will be required to enter this password/security details are determined by your Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay provider.

    If you know or believe that your password has been compromised (e.g. has become known to others), we recommend that you change it immediately.

    Please contact Banca Transilvania urgently on the phone number printed on the back of your BT card, at least in the following situations:

    • If the BT card you have registered in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay is lost or stolen, contact us immediately and let us know that it is also registered in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.
    • If your device is lost, stolen or used without your consent.

    BT accepts no liability for payments made with the BT card enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay until we are notified of one of the above events or until you request that the card be blocked.

    Banca Transilvania is not liable if your BT card has been used for payments via Fitbit Pay/Garmin Pay/Apple Pay/Google Pay based on your password which has been used by other people, whether you have disclosed it to them or they have found out about it in any way without your consent.

    To prevent events like the above from happening, we recommend the following:

    • keeps your device safe and in your possession at all times
    • keeps your security information and device password secure and known only to you
    • Set different passwords/security details for your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay than those used for your physical BT card.
    • do not keep physical BT cards and/or BT card details with the device used
    • If you start using a new device, delete all cards and other personal information from your old device. For details on how to do this, follow your device vendor's instructions.

    You agree to cooperate with Banca Transilvania and/or any competent authority for the prevention of any fraud, or for the conduct of any investigations that may be carried out in connection with the use of your BT card enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    Fitbit Pay /Garmin Pay/ Apple Pay/ Google Pay and your device may use certain security features and procedures to protect against unauthorized use of any card. These features and procedures are the sole property of the device provider. By enrolling your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay you agree not to disable any of these security features and to use them to protect all your BT cards enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Apple Pay/ Google Pay. Banca Transilvania does not control these security methods and is not responsible for how Fitbit/ Garmin/ Apple/ Google and/or your device provider use them.

    6. Registering a BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    After setting your password/ security details, you will be prompted to enter the details of the card you wish to enroll in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, namely: card number, card expiry date, cardholder name as it is written on the card, CVV code, and postal address. All this information (personal data) is required by the Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay provider in order to allow you to use your BT card to pay using this app.

    In order to ensure that the person attempting to enroll a BT card in Apple Pay/Google Pay is entitled to request this enrollment, BT will need to verify the identity of this person. In this regard, in order to complete the enrolment of the BT card in Apple Pay/Google Pay, after the BT card details have been entered into this application, it will be necessary for the cardholder of the card issued in the name of an individual or the legal representative of the legal entity in whose name the BT card is issued to approve the addition of the card from BT Pay, as appropriate, app which can be downloaded free of charge from Google Play, App Store or Huawei AppGallery, or contact BT Contact Centre on 0264308028 or *8028, where a BT representative will ask for information to identify him/her and allow the appropriate token to be set for the BT card to be used in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    The token is a virtual representation of the BT card to be registered in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. The token is set by BT based on information about the device used to access the Fitbit/ Garmin/ Apple/ Google account, as made available to BT by Fitbit/ Garmin/ Apple/ Google and/or third parties with whom BT works.

    Refusal to provide this information, some of which is personal data, will make it impossible to complete the enrolment of the BT card in Fitbit Pay/Garmin Pay/Apple Pay/Google and its use for payment in that application will not be possible.

    Once the BT card is enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay in the BT Contact Center, you will be able to use the BT card for payment via Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    7. General conditions for using BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    The use of BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay for the purchase of goods and services is governed by the terms and conditions of the BT card, which are an integral part of the General Business Conditions of Banca Transilvania applicable, as the case may be, to BT's individual or corporate customers.

    You are also responsible for all uses and transactions made with your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay by third parties to whom you have voluntarily or involuntarily given access to your BT Pay enrolled card, including if those third parties misuse any card or Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    These Terms govern the access and use of your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay only between you, as a BT cardholder, and Banca Transilvania.

    The provider of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay payment-enabled devices and the Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay solution, or third parties with whom they work may have their own terms and conditions and privacy policies. Please be aware that you are subject to such terms and conditions or privacy policies when using Fitbit/ Garmin/ Apple/ Google products and services. Banca Transilvania is not responsible for the way Fitbit/ Garmin/ Apple/ Google and/or third parties with whom it collaborates use the information you make available to them, nor for the personal data they process in the context of the services they offer or when you visit their websites.

    8. How does Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay work?

    a. Making BT card payments via Fitbit Pay/Garmin Pay/Apple Pay/Google Pay

    Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay allows you to make contactless payments with an enrolled card, at POS installed at different merchants, through the device you are using.

    By selecting a virtual card and placing the device you are using near a contactless POS terminal at a merchant's location, you authorize payment for the merchant's products or services.

    b. View BT card information and payments in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    Banca Transilvania provides you with information about the payments made with your BT card enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay in the ways agreed with BT (e.g. account statement, Internet Banking, in BT establishments, etc). This information will be highlighted as payments made with that BT card without indicating that the payments were made via Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.

    Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay can also give you access to information about your BT card payments via Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. Information about the existence of such a possibility and information about this possibility will be provided to you by Fitbit/ Garmin/ Apple/ Google.

    c. Ending the use of the BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    The deletion of the BT card data from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay does not affect in any way the possibility of the BT card to continue to be used for payments, according to the Card Terms of Use, which is an intergral part of the BT General Terms of Business.

    BT will not be liable if your and/or your BT card details are used by Fitbit/Garmin/Apple/Google Pay or third parties with whom it works for purposes other than for making payments via Fitbit Pay/Garmin Pay/Apple Pay/Google Pay, either for the period you use this BT card in Fitbit Pay/Garmin Pay/Apple Pay/Google Pay or after it has been removed from Fitbit Pay/Garmin Pay/Apple Pay/Google Pay.

    You can remove any of your BT cards from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay at any time by pressing the appropriate button or link in the app on your device or by calling the number on the back of your BT card. In these circumstances, you authorise Banca Transilvania to continue processing any outstanding transactions on your BT Card.

    9. Suspension, cancellation and modification of the right to use BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    In addition to any rights to terminate the use of a BT card and/or the card account attached to it, as set out in the General Terms and Conditions of Business of Banca Transilvania, BT reserves the right to cease offering the possibility to use BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay entirely.

    Banca Transilvania also has the right to block, restrict, suspend or cease offering the possibility to use any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay if there is a breach of these Terms, BT's General Terms and Conditions of Business, the conditions stipulated in the card contracts, the terms of Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or if it suspects any fraudulent or improper card activity in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or any other payment method.

    In addition, if the provider of the devices and/or of the Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay application blocks, restricts, suspends or discontinues the use of the Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay application and/or changes its functionality, Banca Transilvania will not be liable towards its customers who have enrolled their BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or towards third parties.

    10. Taxes

    Banca Transilvania does not currently charge any fees for using your BT card via Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay. Should BT decide to charge such fees in the future, it will inform its customers at least two months before they are applied.

    Please be aware, however, that your Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay device provider, and/or third parties with whom they work may charge fees, impose limitations and restrictions that may affect your use of any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, such as but not limited to the use of data or text messaging fees imposed by your mobile phone service provider. You are solely responsible for payment of such fees and agree to abide by any limitations or restrictions imposed.

    11. Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay outages

    Access, use and maintenance of your virtual BT card depends on Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay and your internet service provider's network. Banca Transilvania does not operate Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay or such networks and has no control over their operations. BT will not be liable for any event that interrupts, prevents or otherwise impairs the operation of any BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, such as but not limited to unavailability of the Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay service or internet service, communications, network delays, internet network coverage limitations, system outages.

    12. Modification of these Terms

    We reserve the right to revise these Terms at any time in accordance with the provisions of the General Terms and Conditions of Business of Banca Transilvania.

    We will notify you of changes to these Terms by email or other method of communication set forth in Section XII below. You will also be able to view the revised Terms on your device. If you do not agree to the revised Terms, you will have the right to remove any BT Card from Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay at any time.

    13. Communication in relation to BT cards enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay

    In connection with activating and using your BT card in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay, Banca Transilvania may need to contact you. For this purpose, any of the cardholder's contact details - mailing/ home address, e-mail address, telephone number, as found in BT's records - will be used.

    14. Processing and protection of personal data

    Banca Transilvania SA as controller processes personal data of BT cardholders who wish to finalize their enrollment in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay as mentioned in these Terms, respectively for the identification of persons entitled to request such enrollment (details in section VI of these Terms) and/or in case it is necessary to contact them in relation to BT cards enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay (details in sections XI and XII of these Terms).

    The personal data processed by Banca Transilvania in the context of making payments with BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay are subject to the provisions of General Information Notice on the processing and protection of personal data belonging to BT Customers, an integral part of BT Privacy Policywhich can be found on the website www.bancatransilvania.ro or on request at any branch of the bank.

    Personal data processed by Fitbit/ Garmin/ Apple/ Google and/or third parties in connection with the use of BT cards in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay are subject to the terms of the privacy policies of these entities. Banca Transilvania assumes no responsibility for how they intend to process the personal data of BT cardholders enrolled in Fitbit Pay/ Garmin Pay/ Apple Pay/ Google Pay.
