Changes in the way of payment of distraints to ANAF

Banca Transilvania changes, as of 1 October 2023, the way of payment of garnishments to the National Tax Administration Agency (ANAF) for customers with garnishments ordered by ANAF. The change applies to all banks in Romania, following the Ministry of Finance's Order no. 878/2022.
While until now, banks have been transferring to ANAF the amounts garnished within the legal deadline of 3 working days after the garnishment, as of 1 October this year, banks must communicate to ANAF the amounts that can be paid to the garnishments, as follows:
- by 5 p.m. on the next banking day of the date on which the attachment message was received from ANAF;
- by 5 p.m. on the next banking day on which the amounts were debited from the customer's account.
After the communication of the amounts, ANAF will send a message (called a payment order) to the banks requesting the transfer of the amounts that can be paid, and on the day of receipt of the payment order, the bank will transfer the garnished amounts to ANAF.
After the transmission of the amounts that can be paid to ANAF , no further operations can be carried out that may lead to the reduction of the amounts - until the garnishment is paid or the address for lifting the garnishment is received.
