Terms and conditions of use of the BT Pay mobile application

1. BT Pay and acceptance of the use of the application

These terms and conditions for the Customer (hereinafter referred to as "BT Pay Terms") constitute a contract, legally entered into between Banca Transilvania S.A., a credit institution established in Romania, with registered office in Cluj-Napoca, Calea Dorobantilor, nr. 30 - 36, Cluj county, registered with the Trade Register under no. J12/4155/1993, unique code RO 5022670 (hereinafter referred to as "BT" or "the bank") and you ("the customer" or "the user") for the use of the functionalities of the BT Pay mobile application (hereinafter referred to as "the Application" or "BT Pay") and apply as follows:


A. If you are a Major Customer ("major user"):

We recommend that you read these BT Pay Terms in full before deciding whether to accept them and proceed with the registration process. If you do not agree with any of the provisions of the BT Pay Terms or if you refuse to have your personal data processed as we have informed you in the Information Notice on the processing of personal data in BT Pay, please do not access, browse or use the App, nor the software, services, information, materials or other such contained in the App.

B. If you are a Minor Customer aged between 14 and 18 and have BT Pay linked to your BT account

In order to access/use the BT Pay features for underage users who have BT Pay linked to their account with BT, it is necessary that a parent/guardian/legal representative of your (hereinafter "Parent") expresses his/her consent to this effect to the Bank by accepting the Terms and Conditions of Use of the BT Pay Kiddo features for minors aged 14-18 years who have an account with BT (hereinafter "BT Pay Kiddo Terms for minors who have a BT account").

Even if your parent accepts for you the BT Pay Kiddo Terms for minors who have a BT account for you, we recommend that you read these BT Pay Terms yourself or - if you are unclear about some of the words - with your parent. Please note that of the provisions in section 3. What you can do in BT Pay of these BT Pay Terms, only those relating to transactions that can be carried out by minors over 14 years of age apply to you, as described in section V - BT Pay Kiddo features of the BT Pay Kiddo Terms for minors who have a BT account. C. If you are a minor Customer between 10 and 18 years of age and you want to use BT Pay on your parent's account: 


In order to access/use the features in BT Pay for minor users who have a card issued in their name but linked to their parent's account (hereinafter referred to as "minors linked to parent's account"), it is necessary that a parent/guardian/legal representative of yours (hereinafter referred to as "parent") expresses his/her consent to this effect to the bank, by accepting the Terms and Conditions of Use of BT Pay Kiddo for minors linked to the parent's account (hereinafter "BT Pay Kiddo Terms for minors linked to the parent's account").

If you are between 10 and 18 years old, you will be able to use BT Pay with a card issued in your name, but linked to your parent's account. The process by which you can get access to the app and be issued a BT card must be completed by your parent in BT Pay.

Even if your parent accepts for you the BT Pay Kiddo Terms for minors attached to the parent's account, we recommend that you read these BT Pay Terms yourself or - if you are unclear about some words - with your parent. Please note that, of the provisions in the section 3. What you can do in BT Pay of these BT Pay Terms, only those described in Section V- apply to you. If you do not agree with any of the provisions of the BT Pay Terms that are applicable to users under 14 years of age or if you do not wish to have your personal data processed as we have informed you in the Information Notice on the processing in BT Pay of personal data of underage users attached to the parent account, please do not access, browse or use the App, nor the software, services, information, materials or other such contained in the App.

If at any time after registering with BT PAY you decide that you no longer agree to these BT Pay Terms, please uninstall the application. 

The BT Pay Terms set out how you can use in the BT Pay application the cards issued by Banca Transilvania, (hereinafter referred to as "BT Cards"), the cards issued by other financial institutions in Romania, under the Visa, MasterCard, Maestro logo, enrolled in the 3D secure service, (hereinafter referred to as "Non-BT Cards") and the cards issued by BT Direct (hereinafter referred to as "BT Direct Cards"), as well as access to the accounts opened in the customer's name at Banca Transilvania. The BT Pay Terms and Conditions are supplemented by the General Terms and Conditions of Business of Banca Transilvania applicable to Individuals and Legal Entities (hereinafter referred to as "GTC"), as well as by the official regulations of the loyalty and interest-free instalment payment programmes , in the case of credit cards. 

All these documents are available on the bank's websites - www.bancatransilvania.ro and www.starbt.ro.

In order to use BT Pay, i.e. to be able to view and/or benefit from the services offered within it, you must be a BT customer and/or hold at least one BT debit or credit card, issued to an individual and/or legal entity. 

By registering in the application you confirm that you meet the legal requirements and that you have not been denied the right to use a service such as the one offered by BT Pay. BT makes every effort to prevent misuse of this application and its facilities. The Bank will monitor your use of the application to ensure that it complies with these BT Pay Terms and that the services are not used in an abusive manner and in breach of the law.

2. How do you access BT Pay?

BT Pay is a secure it application, in the form of a digital wallet, accessible via mobile phone with Internet connection. The application can be used on the iOS and Android operating systems and is required to be installed from dedicated stores (Google Play Store – for Android, Huawei App Gallery – for Huawei phones without access to Google services, respectively app store for iOS).

If the bank has ongoing punctual campaigns in which it grants BT Pay users the possibility to send personalized links through which the application can be downloaded, BT Pay can also be downloaded in this way (Invite friends campaigns in BT Pay). You will also be redirected to dedicated stores (Google Play Store – for Android, Huawei App Gallery – for Huawei phones without access to Google services, respectively app store for iOS) to download the app. In certain situations, the Bank may run campaigns with prizes, so customers who install BT Pay by accessing such a received link can be the beneficiaries of prizes mentioned in the rules of the respective campaign, if they meet the eligibility criteria. Users can add BT and non BT cards and use the functionalities of the application, described in detail in the specific guides to each operating system:


1. Opening a business relationship with Banca Transilvania through BT Pay

In order to meet the needs of those who wish to open a business relationship with BT, the bank offers to major individuals, with tax residence only in Romania, the possibility to become BT current account customers directly through the BT Pay mobile application.

In order to apply for opening a business relationship with BT through BT Pay, the above-mentioned persons must have an identity document issued in Romania, such as - Identity Card (CI) or Electronic Identity Card (EC).

Requests to open a business relationship initiated via BT Pay can be: 

  • Approved immediately upon completion of the application process for opening a business relationship through BT Pay;
  • Approved within the next few hours or business days after completion of this application process;
  • Refused, in certain exceptional situations.

Regardless of the final resolution from the Bank, the applicant is informed directly in the application via a push notification.

Applying to open a business relationship with the bank through BT Pay implies acceptance of these BT Pay Terms and involves the processing of personal data as specified in the specific information note.


2. Authentication in the application

User registration will be done by the bank applying the strict customer authentication procedure, as defined in the relevant payment services legislation.

Registration involves the processing of personal data, as detailed in the dedicated information note on the processing of personal data for identification purposes in BT Pay.

Following the registration made according to this point, depending on the category to which the user belongs, i.e. bank customer or card user, the user will have access to all the functionalities of the application or only to some of them, as mentioned in the specific guidelines indicated above.


3. Card registration

Users can add to BT Pay the following types of cards issued in the name of a natural or legal person:

A. BT cards

Users can add Banca Transilvania cards to BT Pay by entering the card data requested from them in the application.

Cards issued in the name of a natural person can be enrolled and used in the BT Pay application even if the user has not taken possession of the physical card. The user can take possession of the physical card either by requesting it by courier or by picking up the card from the territorial units of Banca Transilvania within the term established in the General Business Conditions of the bank.


Adding the card to the BT Pay app also involves activating it, if the activation was not carried out in advance at a BT ATM. If the customer has added the card to BT Pay, activated it, but subsequently takes possession of the physical card, it will be necessary to perform the following operations:

a) the card is reissued at maturity - the user must perform with the physical card a first operation of "Change PIN" from the ATM menu – "PIN administration". As part of this operation, it will be asked for the existing pin code of the card and a new pin code, which may be the same as the existing pin code of the card. In the exceptional situation in which the user receives an error when completing the "PIN change" operation, he addresses to the bank the request for the non-commissioned re-issuance of a new activation code, after which he follows the standard card activation steps from BT ATM.

b) the card is newly issued or reissued on request - it is necessary to activate the physical card at BT ATM and set a pin code for the card issued / reissued.

For phones with Android operating system and built-in NFC technology, for making contactless payments (NFC), the registration of the card and its validation lead to the allocation of a payment token (alternative card number) to that card, a token that will be associated with the card on that phone.

After registering the card in BT Pay, the user can have the possibility to add it to the Google Pay solution directly through the BT Pay application.

The user will also be subject to the Terms and Conditions for the use of cards issued by Banca Transilvania in Google Pay.

For phones with iOS operating system, card data validation takes place, without allocating a payment token to it, the token being required only in the case of NFC payments.

After registering the card in BT Pay, in order to make NFC payments at the merchants' terminals, the user can have the possibility to add it to the Apple Pay solution, directly from the BT Pay app. The user will also be subject in this regard to the Terms and Conditions for the use of the cards issued by Banca Transilvania in Apple Pay.

By adding the card to BT Pay, the user understands that the card can be used to perform financial transactions such as, but not limited to: contactless payments at merchants, making transfers between cards of the same customer, transfers between cards of different customers, based on phone number or IBAN, (in case of transfers based on phone number, the user has the possibility to set up a main card for collection, directly from the card settings, which results in automatic cashing of the chosen card, without the need to accept money from SMS) transfers to BT accounts of BT Pay users/to non-BT accounts of users of the Alias Pay service activated at other banks that have joined the SPL (Standardised Proxy Lookup) scheme ("participating banks") from debit cards issued to individual BT customers, receiving amounts on the account attached to a BT debit card issued to the account of the individual customer holder, based on a telephone number, from customers of other participating banks (only by activating the Alias Pay* service from BT Pay), initiating interbank transfers (to non-BT accounts) by entering the payee's telephone number (without the need to activate the Alias Pay* service), cashing BT cards from non-BT cards, confirming (approving or rejecting, as the case may be) online payments via BT Pay, paying utility bills by accessing the Bill Payments service, viewing card details (card number, cvv, expiry date), contactless cash withdrawals, code-based cash withdrawals, enrolment of cards in the Apple Pay solution (for users of iOS devices), enrolment of cards in the Google Pay solution (for users of Android devices), activation and setting of the Round Up service, issuing or reissuing a debit card, issuing a virtual card, viewing the history of transactions made with the card (including card credits), viewing card expenses grouped by category, viewing the balance of the account to which the card is attached, including for credit cards: viewing monthly payment amounts, viewing transactions made in instalments, early repayment of unpaid amounts from monthly instalments, setting the automatic payment of monthly obligations (minimum and maximum payment amount) from the cardholder's current account, feeding the account to which the credit card is attached with the minimum or maximum payment amount from any card enrolled in the BT Pay application, when applying for shopping offers, offers of services and products of Banca Transilvania, as well as offers of partners.

The use of these functionalities, which involve debiting or crediting amounts, will be made in the bank account to which the respective card is attached, being the responsibility of its holder.

At the same time, after carrying out an additional validation by using the code received by SMS, through BT Pay you can access other functionalities of the application, such as: setting daily trading limits on digital and physical cards, blocking and temporarily unlocking or permanently blocking these cards, updating personal data in the bank's system.

Also, certain categories of users (such as, but not limited to: those identified as customers of the bank, individuals who do not hold a STAR Forte credit card) will be able to apply for a credit card of this type with attached credit line. At the same time, certain categories of users (such as, but not limited to: those identified as customers of the bank, individuals who hold a credit card type STAR Forte, STAR Gold, BT Flying Blue Classic, BT Flying Blue Premium) will be able to apply for the increase of the credit line on the product held.

In addition, certain categories of users (such as, but not limited to: those identified as customers of the bank, individuals, who hold a current account with an attached debit card) will be able to apply for an overdraft line of credit.

By registering with BT Pay, the user understands that he will have access to his current accounts held in BT and will be able to perform operations as defined in chapter 3 below – "What you can do in BT Pay".


B. BT Direct cards

BT Pay users will be able to add cards issued by BT Direct by manually adding the card data, respectively: card number, first name, expiration date, CVV code (3-digit code on the back of the card).

After registering the BT Direct card, the user will be able to use it to perform the following operations: the card balance, viewing the history of transactions made with the card, contactless payment at merchants, enrolling cards in apple pay solution (for users of devices with iOS operating system), enrolling cards in the Google Pay solution (for users of devices with Android operating system), the confirmation (approval or rejection, as the case may be) of online payments through BT Pay.


C. Non BT cards

BT Pay users identified as individual customers of the bank and who have at least one BT card enrolled in the application, can also add non-BT cards to BT PAY by manually adding their data, namely card number, first name, expiration date, CVV code (3-digit code located on the back of the card).

After enrolling the non-BT card in BT Pay, the user has the possibility to access the Open Banking option, which allows him for 90 days to view financial information from other financial institutions where he has opened accounts. After this period, the user can reauter the access to the data for a similar period.

In case of accessing the Open Banking functionality in BT Pay, the user of the application will also be subject to the Terms and Conditions specific to this option.


4. User authentication for accessing and using BT Pay

The app can only be used if the phone is secured by password, fingerprint or another security method provided by the phone. When registering with BT PAY, you check that your phone is secure. Subsequently, each time you access the app, you check that your phone is secure.

The chosen security method will also be used when authorising contactless payments, online payments, ATM withdrawals, transfers, additional card settings and other options that may require authentication.

If the user has set a security code (PIN code) for BT Pay, it will be used to authenticate and authorize transactions in the app, and the user will still have the option to use the phone's security method when paying with the BT Pay app at merchants, without logging into the app (if the phone's unlock payment method is set). If the user has enabled the device unlock function using biometrics (e.g. FaceID, fingerprint), after defining the security code, the user will be allowed to activate the biometrics saved in his/her phone.

You agree and understand that you are responsible for maintaining the confidentiality of the Login Data associated with your use of BT Pay and for taking all reasonable steps to preserve the confidentiality of this information.

You undertake to notify Banca Transilvania immediately, without undue delay, when you notice the absence, theft, misappropriation or unauthorized use of your Login Data, as well as of the mobile phone you use to access BT Pay. You also agree to notify Banca Transilvania immediately, without undue delay, in the same way about any other security breach in connection with the Service of which you are aware.

Banca Transilvania may suspend the use of your Login Details or Account in cases where it suspects that their security has been compromised or that there has been an unauthorized or fraudulent use.

Banca Transilvania will inform you in advance or, if this is not possible, immediately after the suspension of the use of your login data or account, specifying the reasons for the suspension, unless the provision of this information could compromise the reasonable security measures or would contravene the law. Banca Transilvania will reactivate your Login Details or Account or provide you with new Login Details or a new Account as soon as possible after the elimination of the reasons that led to the initial suspension.

If you use BT Pay as a corporate client, you agree that all officials, employees, agents, representatives and all other persons who have issued a card attached to the legal entity account in their name, will be authorized to access the application, make payments with it in the application, view the transaction history made with the card and the limits set on the card issued in their name, temporarily and permanently block the card and access the Offers section.

3. What can you do in BT Pay?

At the same time, on these web pages there are details regarding each functionality of BT Pay that the user has the obligation to consult and take note of.

The current functionalities can be complemented with new ones, communicated according to the operating system, in the mentioned guidelines.

The commissions as well as the maximum daily transaction limit for the operations that the user can perform in the BT Pay application are mentioned in the website of Banca Transilvania.

In the case of BT credit cards,the automatic payment setting of the monthly obligations (the minimum and maximum payment amount) will be made from the cardholder's current account, the payment to be made on the due date. If the due date is a non-working day, the monthly obligation shall be debited on the previous working day. If the user has more than one current account, the first account opened with the bank will be debited.

If the BT card is replenished or the automatic payment option is set outside the interval Monday – Saturday, 09 -19 hours or on non-working days, the power and option will be registered on the next working day. Thus, if such an operation takes place on the due date (the 25th of each month) on a non-working day or outside the above-mentioned interval, the user understands that the monthly payment obligation will not be made within the time limit.

The user can pay for a purchase online from their mobile phone by selecting the "BT Pay" payment method directly from the merchant's page. If the chosen payment method is a credit card, the user can choose to pay in instalments by choosing the number of instalments available on the merchant's website. The user then chooses the card and confirms the transaction by: biometrics (FaceID, fingerprint), or unlocking (password, code).


By accessing the Accounts functionality

The individual user can carry out transactions on current accounts, regardless of whether or not they have a card attached, including accounts attached to credit cards. The user's main RON account will be automatically added following registration in BT Pay.

The "Accounts" section of the BT Pay application offers the user the following functionalities:

  • adding accounts to the BT Pay application
  • viewing active accounts and displaying their balances;
  • view cards attached to each account;
  • transfers between own accounts;
  • making transfers in RON (interbank and intra-banking);
  • making transfers through Alias Pay;
  • viewing, setting and deleting recurring payments;
  • view the history of pending transactions and transfers;
  • IBAN distribution;
  • foreign exchange - for foreign exchange exceeding the amount of 100.000 EURO / USD / GBP versus RON, respectively 25.000 EURO (or equivalent) for the other currency pairs, the Bank offers the possibility to negotiate the exchange rate using alternative channels;
  • automatic import of the beneficiaries saved in the Neo BT and BT24 applications;
  • opening a current account in RON or another currency.
  • making currency transfers (interbank and intrabank; for further information, please consult: Transaction Processing Schedule).

The use of the functionalities within the "Accounts" section is subject to the General Terms and Conditions of Business of Banca Transilvania applicable to the individual client at the time of use.


*Toactivate the Alias Pay service

The application user identified as a customer of the bank, natural person, who has at least one BT debit card issued on the personal account added to BT Pay, can activate the Alias Pay service from the application. This service allows it to receive amounts in the account attached to the BT debit card registered for this service from customers of other participating banks, by entering by the customer payer of another participating bank the phone number of the user registered for the Alias Pay service.

Alias Pay service is offered within the application, but the user can give it up at any time, without affecting the possibility of using the other functionalities of BT Pay. The user of BT Pay will be able to opt out of the use of alias Pay by deleting the alias or previously added to BT Pay.

The use of Alias Pay is subject to the Terms and Conditions applicable to this service and to the processing conditions of personal data specific to it.


By activating the Bill Pay service

The user of the application identified as a customer of the bank, natural person, can access from the application the service Pay Invoices.

This allows individual users to pay utility bills. Through this service, Banca Transilvania provides users with access to:

a) Payment of invoices to approved suppliers using one of the methods below:

  • Connecting the account afferent to an approved utility provider;
  • Connecting your account to the Pago App and importing connected suppliers from within the Pago Application;
  • Scanning a bill received from an approved utility provider, without the aforementioned configuration;
  • Requesting an amount from a third person to pay an invoice.
b) Viewing the history of payments made to the approved suppliers;

The use of Pay Invoices is subject to the Terms and Conditions applicable to this service and to the processing conditions of personal data specific to it.

The Pay Invoices service is offered within the application, but the user may not use it or give up at any time the activated payment options, without thereby affecting the possibility of using the other functionalities of BT Pay.

The user of BT Pay will be able to opt out of the use of the Pay Invoices service by deleting / disconnecting all the connected providers and disabling the existing payment options, in case of their activation.

By accessing the Round Up functionality

Certain categories of users of the application (such as, but not limited to: those identified as customers of the bank, individuals, holders of a current account in RON and with at least one own card issued in RON, added to BT Pay, will be able to access the Round Up functionality and will be able to activate their option on the main current account in RON. Option is activated at account level. All payments made with cards attached to that account will benefit from this option.

The payment transactions accepted for the Round-Up service are:

  • Payment by debit card or through wallet applications made at a POS;
  • Payments made online using the debit card;

Overdraft payments, as well as transfers made from the current account (scheduled or not), cash withdrawals by debit card, ATM invoice payments will not be rounded up. Also, the payments made with the BTDirect card and the payments with the BT meal ticket card will not be rounded.

The minimum intangible balance is 30 lei, which means that the rounding cannot be made if the balance of the source account is less than or equal to 30 lei.

The use of this service is subject to the Terms and Conditions applicable to it.

By accessing the Savings functionality

The user of the application identified as a customer of the bank, a natural person, an account holder, who has set a PIN (security code), can access from BT Pay the "Savings" functionality.

Within the Savings functionality, the user can view the savings products held at Banca Transilvania, can set up other deposits/savings accounts available in the bank's offer, respectively can cancel them through the application.

The establishment of deposits/savings accounts is subject to the Terms and Conditions applicable to each of these products, as follows:


By accessing the credit card option

Certain categories of users of the application (such as, but not limited to: those identified as customers of the bank, natural persons, residents, who have a BT debit card issued on the personal account added to BT Pay, except for the BT meal card), and who do not have a STAR Forte credit card issued as a holder, I can view the credit card application option in the app. This service allows the user to initiate a request to grant a STAR Forte credit card and, if the criteria of the BT credit policies are met, to obtain this card and the related credit line.

Certain categories of users of the application (such as, but not limited to: those identified as customers of the bank, individuals, residents, who have a BT debit card issued on the personal account added to BT Pay, except for the BT meal card), who hold a credit card STAR Forte, STAR Gold, BT Flying Blue Classic, BT Flying Blue Premium issued as holder, can view in the application the option of increasing the credit line for the product owned. This service allows the user to initiate a request for a credit line increase and, if the criteria of the BT credit policies are met, to obtain the increase of the credit line related to the product he owns.

The option to increase the credit line is offered within the application, but the user is not obliged to access it, the non-access to this option does not affect the user's right to use the other functionalities of BT Pay.

The use of this functionality involves the processing of personal data as specified in the Information Note on the processing of personal data for obtaining a BT credit card exclusively online. 


By accessing the overdraft facility/cash reserve option

Certain categories of app users (such as, but not limited to: those identified as individual, resident bank customers who have a BT debit card issued on their personal account added to BT Pay, except for the BT meal card), can view the option to apply for overdraft. This service allows the user to initiate an overdraft request and, if the award criteria in the BT lending policies are met, they can obtain the overdraft.

The overdraft option is offered within the application, but the user is not obliged to access it. Failure to access this option does not affect the user's right to use the other features of BT Pay.

The use of this functionality involves the processing of personal data as specified in the Information Note on the processing of personal data for the exclusively online obtaining of an overdraft


By accessing the option to issue MTPL Insurance

The user of the application identified as a customer of the bank as an individual can access from the BTPay application the "MTPL Insurance" option. Through this option, the customer can view the offers of MTPL insurance suitable for his car and can purchase directly from BTPay MTPL insurance. After the policy has been issued, the customer will receive a copy of the policy by email, but the customer can always resend the policy by email from the application.

The customer will also receive notifications about the expiry of the insurance policy: one notification 30 days before the expiry date of the insurance and another notification 7 days before. 

The issuance of the MTPL insurance policy is subject to the Terms and Conditions applicable to this service and the Conditions for processing personal data specific to this service.

By accessing the Travel Insurance option

The application user identified as a customer of the bank as an individual can access the "Travel Insurance" option in the BTPay application. Through this option, if a number of criteria are met, the customer can view the travel insurance offer suitable for him based on a needs analysis and can purchase travel insurance directly from BTPay. After the policy has been issued, the client will receive the policy and the complete set of documents specific to this insurance by e-mail.

By accessing the BT Pay Kiddo option for minors who have a BT account

The adult user of the application, identified as a customer of the bank as an individual account holder, can activate from the BT Pay application the BT Pay Kiddo option for minors who have a BT account, whereby he/she can give his/her child or minor, aged between 14 and 18 and who has an account with BT, permission to use the BT Pay application via the card issued in the minor's name, attached to the minor's account. Use of this feature is subject to the Terms and Conditions applicable to this service.

By accessing thețBT Pay Kiddo for minors attached to the parent's account

The adult user of the application identified as a customer of the bank as an individual account holder can activate from the BT Pay application the BT Pay Kiddo option for minors attached to the parent's account, whereby he/she can give his/her child or minor, aged between 10 and 18 years old, permission to use the BT Pay application via the card issued in the name of the minor, attached to the parent's account. Use of this functionality is subject to the Terms and Conditions applicable to this service.

By accessing the Move your money to BT option

The user of the application, who is a customer of the bank and an individual account holder, can access the "Move your money to BT" option, whereby he can transfer, with the desired recurrence, the income or other amounts that are in the account opened at another financial institution to which a non-BT card enrolled in BT Pay is attached, to an account to which a BT card already registered in the application is attached. 

When activating the option, the user must ensure that the available balance in the non BT account from which the amounts are to be transferred to the BT account is sufficient to perform the desired recurring transaction. Transfers will be made with the set recurrence and the chosen amount only if there will be available balance in the non BT account at each of the set recurring transfer dates.

By using the identification option in BT Pay

BT individual customers, BT Pay users, will have the possibility to be identified during a phone call initiated to/from the Call Center or, as the case may be, in the case of transactions carried out in BT units, through the Application installed on the phone number declared by the bank. Customers opting for such identification will receive a push notification sent to BT Pay, from where they can accept/refuse identification or identify themselves using the phone unlock method/security code used for BT Pay.

By accessing the functionality Phone card loading

BT Pay users can load a phone card (prepaid) for phone numbers from providers available in the application by entering the phone number whose loading is desired. The user is aware that these transactions are irreversible. The user assumes the correctness of the phone number entered and that he/she has the consent of its holder for its use in BT Pay for the purpose of loading the card.

By accessing the Loans functionality

The user of the application identified as a customer of the bank, natural person, holder of a credit account, can view in BT Pay, in the "Loans" functionality, details about the non-card credit products held at Banca Transilvania (e.g. due date, payment amount, repayment schedule, any amounts due, insurance policies attached, fees, any delays).

4. Representations and Warranties

At the time of registration for the use of BT Pay, you represent and warrant the following:

  • you have full right, authority and capacity (valid only for adult users) to access and use the application;
  • that you are the holder of the cards issued by Banca Transilvania and / or issued by other financial institutions in Romania that you add to the BT Pay application;
  • you are required to maintain a method of unlocking your phone while the BT Pay app is installed on your phone;
  • you will not disclose your phone unlock password/security code to a third party, as by disclosing it you expose yourself to the risk of other people using your cards for payment. You are solely responsible for maintaining the confidentiality and security of the data entered into the BT Pay application and the BT Pay phone unlock password/security code. Furthermore, you are responsible for all activities of any nature that occur on your account;
  • if you have chosen to enable biometrics for authentication in BT Pay, you will not allow biometric data - fingerprints or face ID - belonging to other people to be registered on your phone, as in this case, accessing the application and authorising transactions could be done with any of the biometric data added to your phone;
  • you will notify us immediately of any unauthorized use of the application installed on your phone number or any breach of your phone security or application login data that you become aware of or reasonably should suspect.
  • you assume full responsibility for the case when the phone number entered / selected by you in BT Pay or the IBAN code entered, to which you ordered the bank to transfer / request amounts of money is wrong or does not belong to the person to whom you intend to transfer / request the amount of money;
  • you assume full responsibility if the telephone number you entered/selected in BT Pay, to which you instructed the bank to transmit the code required for cash withdrawal without a card is wrong or for which you requested to load a phone card, does not belong to the person to whom you intended to transmit the code/load the phone card or if this code was subsequently transmitted by the recipient to another person;
  • you assume full responsibility if the phone number entered in BT Pay for loading a phone card does not belong to the person you intended to load the phone card or the phone card was loaded by another person;
  • you assume full responsibility for connecting to the Open Banking functionality, which allows for 90 days from the login to the respective application, through BT Pay, the display of financial information of your account opened at another financial institution, namely: balance, IBAN account, transaction history and details. At the same time, you assume the correctness of the association of the account with the non BT card enrolled in BT Pay, in order to correctly display this information.
  • you assume full responsibility for the distribution on any distribution channels of links and / or messages promoting the campaigns that may be carried out through the BT Pay application and you guarantee to the bank that you will not misuse these distributions abusively;
  • you will not disclose to third parties the OTP code received on your phone number for adding your card to BT Pay and/or unlocking various functionalities, including permission to authorise online payments;
  • you will notify us in case of missing, lost, unauthorized access or theft of the mobile phone on which the BT Pay application is installed, as soon as you become aware of this situation. In the event that you fail to comply with the above obligation, you assume full responsibility for any and all operations that unauthorised persons may carry out through the App or as a result of identification carried out through the App installed on the telephone number declared to the bank during a call to/from the BT call centre or in a BT unit, including accessing any bank information or updating data;
  • you will uninstall the application if the phone you originally installed it on is no longer yours or you no longer use it;
  • you will not falsify or give false information about your identity or intentions in connection with anything related to the application;
  • you will not transmit, distribute or provide any information or materials that are in whole or in part unlawful, false, fraudulent or otherwise inappropriate, offensive or in violation of public policy or morality;
  • you will ensure and maintain the physical and logical security of the phone, according to the manufacturer's recommendations and best practices;
  • you will update your phone's operating system according to the manufacturer's recommendations and use only the official versions of the operating system provided by the manufacturer;
  • you will not inhibit the operating system security protections recommended by the phone manufacturer;
  • you will install BT Pay only from the dedicated stores - Google Play Store, Huawei App Gallery or App Store, Romania, published by Banca Transilvania;
  • not to install apps from unofficial sources, as they could compromise the security of the app
  • you will ensure that any data entered into the application is correct and complete;
  • you will not infringe any statutory rights, property rights, intangible rights, privacy rights or personal data of others;
  • you will not use the content of the application to resell, distribute or use the services offered.
  • you will not distribute the offers from the BT Pay app.
  • you will not misuse and/or use in bad faith and/or for fraudulent purposes the functionalities offered within the application;
  • you will access via BT Pay only accounts opened in your name in physical activity monitoring applications and you will keep this data confidential;
  • you confirm that you have read the provisions of these BT Pay Terms that apply to you, that you agree to them and that you are aware of the way in which personal data will be processed in accordance with the provisions of the Information Notice on the processing of personal data within BT Pay (if you are an adult user), respectively in accordance with the provisions of the dedicated Information Notice on the processing of personal data of minor users within BT Pay;
  • by using the App you will not violate any laws or regulations of the country in which you reside and you are solely responsible for compliance with all applicable local laws and regulations.

5. Termination or modification of BT Pay

The termination of the use of BT Pay by the user may occur in the following situations:

a) at the initiative of the user,by uninstalling the application from your device.

b) at the initiative of the bank, in case of breach by the user of the provisions of these BT Pay Terms;

c) when the business relationship between the customer and the Bank ceases .


We can also suspend or change BT PAY immediately for any reason, including when it requires repair or maintenance work. We may periodically add new features and are not obliged to offer any particular feature through BT PAY. We may withdraw BT PAY, but in this case we will give you at least 30 days' notice.

We may amend these BT Pay Terms at any time by publishing the amended BT Pay Terms in the BT PAY application. In this case users will be notified via the app and/or by other communication method using the contact details held in the bank's records. From the time of notification or, as the case may be, from the date indicated in the notification as being the date from which these BT Pay Terms are amended, the updated version of these BT Pay Terms will apply to all users.

If you do not agree to the revised BT Pay Terms, you may uninstall the BT Pay application at any time, effective immediately.

In the event that additional Services made available in the Application are implemented, these Services will be subject to the same rules and conditions contained in these Terms, unless they benefit from conditions distinct from these Terms.


6. Intellectual Property

The user expressly declares that he is aware that all graphic creation, application content and audio-video materials accessed are the property of the Bank. Except for information, graphics belonging to other entities, which are the property of partners.

The user accepts that any software used in connection with the services offered in the application contains confidential and proprietary information, being protected by the laws of intellectual property, industrial and other applicable laws.

The user undertakes not to reproduce, copy, sell or exploit the services, information and / or audio-video materials to which he has access as a result of the use of this application, in part or in full.

The user is prohibited from modifying, copying, renting, assigning, lending, selling, distributing or creating derivative materials based on the services or programs used within the application.

7. Why we are not responsible

We provide BT PAY for your personal use only. Not all BT PAY services will work with all mobile devices.

You agree that the application will not be delivered error-free or continuously, that some imperfections will not be corrected when they occur.

The user of the application is responsible for the use of the application. Banca Transilvania cannot be held responsible for the effects generated by the use of the application by the user or third parties, for the costs generated by the use of the application or for the access of third parties to certain personal and/or confidential information or personal data through the application. In order to limit potential damage caused by the use of the application by third parties, Banca Transilvania recommends that you do not hijack/borrow your phone, do not disclose the device unlocking method/security code used for BT Pay and do not give your card to other people.

Banca Transilvania cannot control the operating system of the phone used by you. Thus Banca Transilvania is not responsible for any damage caused to your mobile phone, including but not limited to any security breach caused by viruses, bugs, cheating, tampering, omission, interruption, malfunction, delay in operations or transmissions, computer lines or network failure or any other technical malfunction caused.

As such, we will not be liable for any loss or damage which we or you could not reasonably foresee at the time you started using BT PAY or which is beyond our control.

We will also not be responsible for:

a, no loss or damage (moral or pecuniary) due to non-compliance with these BT Pay Terms;

b. if persons whose telephone numbers have been entered into the application by you for making transfers based on the telephone number or for transmitting the code required for cash withdrawals without a card claim the use of this contact data belonging to them;

c. content or services/discounts provided by STAR partners through offers displayed in the BT Pay App, unavailability or non-updating of offers;

d. associate the non BT card enrolled in the application with the selected account within the Open Banking functionality in order to display the correct information.

e. the accuracy of data in the applications, availability or reliability of any information, content, made available by any third party application, for example physical activity monitoring applications. As such, we are not liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on such third party applications.

f. health problems that may result from the use of these devices and applications, from the physical activity performed by the user.

g. any loss or corruption of your content or other data, if such loss or corruption is not caused by us or is beyond our reasonable control. You are also advised that Banca Transilvania shall not be liable to you and/or any third party for any direct or indirect damages of any kind including, but not limited to, loss of profits, lost profits and/or lost business opportunities or any other similar losses suffered by you as a result of the lack of use of the Application and Services or the inadequate quality of the Services.

8. Governing Law

The terms and conditions of use of the BT Pay application, as set forth herein, are and will be governed by and construed in accordance with the law of Romanian.

In case of a conflict / misunderstandings related to the use of the application, we will try to resolve the respective conflict amicably, the negotiations in this regard being governed by good faith.

All disputes will be settled in the competent courts of the municipality of Cluj-Napoca, except in cases where the legislation in force specifies another exclusive jurisdiction for you.

Specific provisions for US users of BT Pay

If you are a US user of the BT Pay app (a user whose identity documents used in the identification/authentication process through the app have been issued by the competent authorities in the United States of America), by accepting these Terms and Conditions you agree that:
(i) any claims/ grievances relating to the processing of your personal data (such as, but not limited to, biometric data) by the identity verification provider/ third party service provider whose solutions are used within the aforementioned application (hereinafter, for the purposes of this Onfido clause) will NOT be subject to litigation/ class action lawsuits subject to resolution in the courts of the United States of America;
(ii) any complaints/ grievances relating to the processing of your personal data referred to in clause. (i) will be subject to individual arbitration proceedings;
(iii) the resolution of any claims/ grievances relating to the processing of your personal data referred to in paragraph (i) under paragraph (ii) by arbitration shall be in strict accordance with the arbitration procedure established by the identity verification service provider/third party (Onfido) as communicated to you by Onfido.

10. Force Majeure and fortuitous case

Banca Transilvania is not liable to the user for the failure to fulfill any obligation in case of force majeure / fortuitous case and in general in the event of an event that is beyond its control, as well as for the operation and connection of other national or foreign networks and for their activities and actions in general.

The case of force majeure / fortuitous case can be, for example but not limiting: state of war (whether declared or not), armed conflict, revolution, insurrection, military or terrorist actions or threats, sabotage, civil unrest, strikes or other actions in the labor market, laws, regulations, decisions or directives, natural disasters, earthquake, fire, explosion, solar or meteorological disturbances, public emergencies or any other incident, which is beyond the control of the bank.
